By using Yaytrail ("Yaytrail.com"), you are agreeing to be bound by the following terms and conditions ("Terms of Use").

Basic Terms

  1. You are responsible for any activity that occurs under your screen name and responsible for keeping your username and password secure
  2. You promise not to use the Yaytrail.Com Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by Yaytrail.Com By way of example, and not as a limitation, you agree not to use the Services:
    • to abuse, harass, threaten, impersonate or intimidate other Yaytrail.com users
    • to post or transmit, or cause to be posted or transmitted, any Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party
    • for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content
    • to post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any Yaytrail.com user
    • to create or submit unwanted email ("Spam") to any other Yaytrail users or any URL
    • You must not transmit any worms or viruses or any code of a destructive nature
    • to violate any laws in your jurisdiction
    • attempt to impersonate another user or person
    • sell or otherwise transfer your profile.
  3. You must be 13 years or older to use this site.

Violation of any of these agreements above will result in the termination of your Yaytrail.com account. While Yaytrail.com prohibits such conduct and content on its site, you understand and agree that Yaytrail cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the Yaytrail.com service at your own risk.

General Conditions

  1. We reserve the right to modify or terminate the Yaytrail.com service for any reason, without notice at any time. Upon termination of your account, your right to use Yaytrail will immediately cease. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
  2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you by email. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
  3. We reserve the right to refuse service to anyone for any reason at any time.
  4. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
  5. Subject to full compliance with the Terms of Use, Yaytrail.com may offer to provide certain services and content, as described more fully on the Site, ("Services"). Services shall include, but not be limited to, any service and content Yaytrail.com performs for you, as well as the offering of any materials displayed, transmitted or performed on the Site or through the Services (including, but not limited to text, user comments, messages, information, data, graphics, news articles, photographs, images, illustrations, also known as the "Content"). Yaytrail.com may change, suspend or discontinue the Services including any Content for any reason, at any time, including the availability of any feature or content. Yaytrail.com may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.
  6. The Yaytrail.com service makes it possible to post images and text hosted on Yaytrail.com to outside websites. This use is accepted. However, pages on other websites which display data hosted on Yaytrail.com must provide a link back to Yaytrail.com
  7. The Services may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Yaytrail has no control over such sites and resources, you acknowledge and agree that Yaytrail is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Yaytrail shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

Copyright

  1. We claim no intellectual property rights over the material you provide to the Yaytrail.com service. Your profile and materials uploaded remain yours. You can remove your profile at any time by deleting your account. This will also remove any content you have stored in the system.

Non-Disclosure

By using Yaytrail.com you are agreeing to be bound by the non-disclosure agreement at http://www.yaytrail.com/nda

Indemnity

You will indemnify and hold harmless Yaytrail, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys. fees and cost) from (i) any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms of Use by you, or the infringement by you, or any third party using your account or Yaytrail account, of any intellectual property or other right of any person or entity.

Limitation of Liability

IN NO EVENT SHALL Yaytrail OR ITS SUPPLIERS BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR OTHER LEGAL THEORY (I) WITH RESPECT TO THE SITE, THE SERVICE OR ANY CONTENT FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING), OR (II) FOR ANY DIRECT DAMAGES IN EXCESS OF (IN THE AGGREGATE) $100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
